    Think Fencing PTY LTD Limited Lifetime Warranty

    Purpose of this document

    1. Think Fencing Pty Ltd herein after referred to as (TF) has manufactured all of the plastic components (including vinyl, ASA and MDPE components) that make up tis fencing range and used for both fencing posts and rails (“End Product”) to be supplied to (“You”)
    2. TF prides itself on the quality of all if its materials and products.
    3. This warranty offers you rights and protection in respect to the material used for the end product.

    Rights and protection (Subject to limitations and qualifications set out below)

    1. Please note:
      1. This warranty is subject to the limitations and qualifications set out below. Please read these limitations and qualifications carefully. If you have any questions please contact (TF)
      2. The period of this Warranty has been determined in considerations of the intended use of the End Product and the location at which the end product will be used.
    2. (TF) warrants that the material used for the end product for use on a private property will have a life free from defects caused by faulty materials or manufacturing defects.
      1. This warranty only applies to the products manufactured and supplied by (TF) or its certified re-sellers and subject to:
        1. The installation of the materials being carried out in accordance with (TF)’s instructions.
        2. The installation not having been compromised in any way due to faulty workmanship or installation. Should such workmanship or installation occur at the site address, (TF) at its discretion declare this warranty null and void.
      2. This warranty covers manufacturing defects including blistering, flaking, peeling or premature decomposition of its vinyl, ASA and MDPE components.
      3. This warranty covers material against premature decomposition and such premature decomposition is defined as the material being unsuitable and no longer fit for the purposes within a reasonable period for its geographical locations. The definition of “purpose” meaning the material being unserviceable for the purpose of fencing barriers but not enclosures.
      4. (TF) manufacturers and designs its material to collapse and or break under impact to reduce any potential injury to any animal, person or property which could be in a position of contact with or near the fencing system. This warranty does not cover any such injuries or damages sustained to any animal, person or property as a result of the fencing system breakdown and (TF) will not be held responsible for any such damages to animal, person or property.
      5. (TF) warrants that if any material used becomes necessary to be replaced under this warranty, the material used as its replacement may be substituted for a comparable product of quality and price should (TF) have changed its formula, product range and/or color due to meeting changing market demands as new designs and technology emerge.

    Rights of consumers under the Australian Consumer Law

    1. Clause 2 Applies to you if:
      The end product is of a kind ordinarily acquired for personal, domestic, rural or household use or consumption,
      Unless you acquired the end product for the purpose of re-supply or the purpose of using it up or transforming it in trade or commerce.
    2. (TF) products come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if goods fail to be of acceptable quality and failure does not amount to a major failure.
    3. The benefits given to you by this warranty are in addition to other rights and remedies you may have under and law in relation to end products.

    Enquiries or Notification

    1. Please note that any claim under this warranty must be
      1. Notified to (TF) within a reasonable time (and in any event no more than 30 days) after you first noticed or ought reasonably to have noticed the issue/defect. If (TF) is not notified of the claim within a reasonable time of your first noticing the issue/defect, (TF) may in its absolute discretion deny the claim and (TF) shall have no liability under this warranty.
